Terms of Service

These Terms of Service (“Terms”) govern access to and use of the LangProtect website, platform, APIs, browser extensions, dashboards, and related services (collectively, the “Services”) provided by LangProtect (“LangProtect,” “we,” “us,” or “our”).

By accessing, using, or registering for the Services, whether as an individual or on behalf of an organization, you (“you,” “User,” or “Customer”) agree to be bound by these Terms. If you are using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case “you” refers to that entity.

These Terms apply to all users of the Services, including visitors to the website, users of free or trial offerings, and customers who subscribe to paid plans. Certain Services may also be subject to additional terms, policies, or documentation, which are incorporated by reference where applicable.

LangProtect provides security infrastructure designed to inspect, filter, and enforce controls around interactions with large language models and AI systems. The Services do not generate AI responses, do not replace underlying AI models, and do not guarantee the prevention of all security incidents. Use of the Services is subject to the limitations and disclaimers set forth in these Terms.

If you do not agree to these Terms, you must not access or use the Services.

For the purposes of these Terms, the following definitions apply. Defined terms may be used in the singular or plural as the context requires.

“Account” means the registered user account created to access and use the Services, including associated credentials, API keys, configurations, and permissions.

“Authorized Users” means individuals who are permitted by a Customer to access and use the Services under the Customer’s Account, including employees, contractors, or other representatives acting on the Customer’s behalf.

“Customer” means any individual or legal entity that registers for, accesses, or uses the Services, whether through a free offering, trial, or paid subscription.

“Customer Content” means any data, text, prompts, inputs, metadata, configurations, or other information submitted to or processed through the Services by or on behalf of the Customer, including content transmitted for inspection, scanning, or enforcement purposes.

“Dashboard” means the web-based interface provided by LangProtect through which Customers can manage Accounts, configure policies, view analytics, monitor activity, and administer Authorized Users.

“Free Trial” means a limited, time-bound or usage-bound access to the Services provided at no charge, subject to these Terms.

“Policies” means the configurable security rules, scanning configurations, enforcement settings, and governance controls made available through the Services.

“Services” means LangProtect’s software, APIs, browser extensions, dashboards, scanning engines, analytics, and related functionality provided by LangProtect, including any updates, enhancements, or modifications.

“Subscription” means a paid access plan to the Services governed by usage limits, pricing tiers, and billing terms selected by the Customer.

“Third-Party Services” means external platforms, tools, AI models, applications, or services not operated by LangProtect that may integrate with or be used in connection with the Services.

“User” means any individual who accesses or uses the Services, including Authorized Users.

You may use the Services only if you are legally capable of entering into a binding agreement under applicable law. By accessing or using the Services, you represent and warrant that you meet all eligibility requirements and that your use of the Services complies with these Terms and all applicable laws and regulations.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In such cases, acceptance of these Terms is deemed acceptance by the organization, and the organization is responsible for all actions taken by its Authorized Users.

The Services are not intended for use by individuals who are prohibited from receiving services under applicable export control, sanctions, or other regulatory restrictions. You may not access or use the Services if doing so would violate any applicable law, regulation, or court order.

By creating an Account, accessing the Dashboard, using the APIs, installing any extensions, or otherwise interacting with the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Services.

To access certain features of the Services, you must create an Account. When registering, you agree to provide accurate, current, and complete information, including your name, work email address, company name, and any other information required to enable access to the Services. You are responsible for keeping this information up to date.

You are solely responsible for maintaining the confidentiality and security of your Account credentials, including usernames, passwords, API keys, tokens, and any other authentication mechanisms associated with your Account. You agree not to share credentials with unauthorized parties and to ensure that only Authorized Users are granted access under your Account.

All activity that occurs under your Account, whether conducted by you or by Authorized Users, is your responsibility. LangProtect will treat any actions taken through your Account as authorized unless and until you notify us of unauthorized access. You must promptly notify LangProtect if you suspect or become aware of any unauthorized use of your Account, credentials, or security compromise.

You are responsible for ensuring that Authorized Users comply with these Terms and any applicable policies. LangProtect may, at its discretion, limit, suspend, or revoke access to the Services if it determines that Account activity poses a security risk, violates these Terms, or may negatively impact the Services or other users.

You may not use the Services to impersonate another individual or entity, misrepresent your identity or affiliation, or attempt to gain unauthorized access to systems, data, or accounts.

You are responsible for ensuring that your use of the Services complies with these Terms and all applicable laws and regulations. This section outlines your obligations and the standards of conduct expected when accessing or using LangProtect.

All rights, title, and interest in and to the Services, including the platform, software, dashboards, APIs, scanners, policies, workflows, documentation, designs, trademarks, logos, and any related technology, are and will remain the exclusive property of LangProtect or its licensors. These Terms do not grant you any ownership rights in the Services, but only a limited, revocable, non-exclusive, non-transferable right to access and use the Services in accordance with these Terms.

You retain full ownership of any data, prompts, inputs, configurations, or other content that you submit to or process through the Services. LangProtect does not claim ownership over your data and does not use customer data to train models. The Services operate as a security and analysis layer that processes data transiently for the purpose of detecting threats, enforcing policies, and generating security insights.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to derive the source code of any part of the Services, except to the extent such restrictions are prohibited by applicable law. You may not remove, obscure, or alter any proprietary notices contained in or associated with the Services.

Any feedback, suggestions, or ideas you voluntarily provide regarding the Services may be used by LangProtect without restriction or obligation to you, provided such use does not involve your confidential or personal information.

All trademarks, service marks, and branding elements associated with LangProtect are protected by applicable intellectual property laws. Unauthorized use of these marks is strictly prohibited.

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, LangProtect disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability.

LangProtect does not warrant that the Services will be uninterrupted, error-free, or completely secure. While the Services are designed to detect, analyze, and mitigate AI-related security risks, no system can guarantee complete prevention of misuse, breaches, or malicious activity. Security outcomes depend on multiple factors, including user configurations, integrations, policies selected, and external systems beyond LangProtect’s control.

LangProtect does not guarantee that all threats, vulnerabilities, or policy violations will be identified or blocked. The Services provide risk detection, monitoring, and enforcement capabilities, but they are not a substitute for comprehensive organizational security practices, governance, or compliance programs.

Any insights, alerts, analytics, or recommendations generated by the Services are provided for informational and security-support purposes only. They should not be interpreted as legal, regulatory, medical, or professional advice. You are solely responsible for determining how to respond to identified risks and for ensuring compliance with applicable laws and internal policies.

LangProtect is not responsible for issues arising from third-party services, integrations, models, APIs, or tools that you connect to or use in conjunction with the Services. Any downtime, errors, data exposure, or misuse caused by third-party systems remains outside LangProtect’s responsibility.

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the above disclaimers will apply to the fullest extent permitted by applicable law.

To the fullest extent permitted by applicable law, LangProtect’s total liability arising out of or relating to these Terms or the use of the Services is limited as set out below.

Cap on Liability: LangProtect’s aggregate liability for all claims, damages, losses, and causes of action will not exceed the total amount paid by you to LangProtect for the Services in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

Excluded Damages: LangProtect will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. This includes, without limitation:

• Loss of profits, revenue, or business opportunities
• Loss of data, data corruption, or system downtime
• Reputational harm or loss of goodwill
• Security incidents arising from third-party systems or user configurations

AI-Specific Risk Acknowledgement: You acknowledge that AI systems inherently involve probabilistic behavior and evolving threat landscapes. LangProtect is not liable for outcomes resulting from:

• Incorrect, incomplete, or misconfigured policies or scanners
• User decisions made based on insights or alerts
• Model behavior, hallucinations, or failures originating from third-party AI providers

Third-Party Services: LangProtect bears no responsibility for failures, vulnerabilities, or damages caused by third-party platforms, AI models, APIs, integrations, or infrastructure used alongside the Services.

Jurisdictional Limits: Some jurisdictions do not allow the limitation or exclusion of certain damages. Where such limitations are not permitted, LangProtect’s liability will be limited to the minimum extent allowed by applicable law.

This limitation of liability applies regardless of the legal theory under which a claim is brought, including contract, tort, negligence, strict liability, or otherwise, even if LangProtect has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless LangProtect, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:

• Your use or misuse of the Services
• Your violation of these Terms or applicable laws and regulations
• Content, data, or prompts submitted through your account
• Your integration of LangProtect with third-party systems, AI models, or tools
• Any actions taken based on outputs, alerts, or security decisions generated using the Services

LangProtect reserves the right to assume exclusive control of the defense of any matter subject to indemnification, in which case you agree to cooperate fully with such defense.

Termination by You: You may terminate your account or subscription at any time by discontinuing use of the Services or by contacting LangProtect through the appropriate account or support channels. Termination does not relieve you of any payment obligations incurred prior to the effective termination date.

Termination by LangProtect: LangProtect may suspend or terminate your access to the Services, in whole or in part, if:

• You violate these Terms
• Your use poses a security, legal, or operational risk
• Required by law or regulatory authority
• Your account remains inactive for an extended period
• Payment obligations are not fulfilled

Where reasonable, LangProtect will provide notice before termination. In urgent cases involving security or legal risk, termination may occur immediately.

Effect of Termination: Upon termination:

• Your right to access and use the Services immediately ceases
• API keys and credentials may be revoked
• Access to dashboards, analytics, and logs may be disabled
• Any outstanding fees remain payable

Termination does not affect provisions that by their nature should survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law.

These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which LangProtect is incorporated, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the competent courts of that jurisdiction, unless otherwise required by applicable law. Nothing in this section limits either party’s right to seek injunctive or equitable relief in any jurisdiction to protect intellectual property rights, confidential information, or prevent unauthorized use of the Services.

If you are accessing the Services from a location outside LangProtect’s country of incorporation, you are responsible for complying with all local laws and regulations applicable to your use of the Services.

Entire Agreement: These Terms constitute the entire agreement between you and LangProtect regarding the use of the Services and supersede all prior or contemporaneous agreements, understandings, or communications, whether written or oral.

Severability: If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver: Failure by LangProtect to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of LangProtect.

Assignment: You may not assign or transfer these Terms, in whole or in part, without LangProtect’s prior written consent. LangProtect may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force Majeure: LangProtect will not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including natural disasters, acts of government, labor disputes, internet outages, or failures of third-party service providers.

Relationship of the Parties: Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and LangProtect.
